Appeal court approves adoption practice

A Sheriffdom of Lothian and Borders practice note on eficient management of contested adoption and parental responsibilities proceedings has been approved by the Inner House

The Sheriff Principal of Lothian and Borders has issued a practice note which provides sheriffs and practitioners with guidance about the efficient management of contested proceedings in applications concerning adoption and parental responsibilities orders. The object is to encourage active case management by the sheriff in the interests of the child so that the application is dealt with as expeditiously as possible, as required by Lothian Regional Council v A 1992 SLT 858.

The practice note, available online at, was approved by the First Division in Dundee City Council, Petitioners, 27 February 2004, the court commenting that similar guidance should be provided in other sheriffdoms.
