SLAB right to refuse court fees

Where assisted clients are exempt from paying court fees, the Scottish Legal Aid Board is right to refuse to reimburse solicitors who have erroneously paid fees

It has been brought to the Society’s attention that there has been some confusion regarding the exemption from payment of court fees. The Legal Aid Committee points out that the exemption form makes it clear that there is no requirement for solicitors to make payment in circumstances where they have regulation 18 cover.  The Committee agreed that the Scottish Legal Aid Board’s refusal to reimburse solicitors who have erroneously paid the court fee was correct.
