Reminder on prisoner deliveries

A reminder that under the Code of Conduct for Criminal Work, only a business card and legal document should be given to a person in custody


Practitioners are reminded that article 6 of the Code of Conduct for Criminal Work states that “a business card and legal document should be the only items given by a solicitor to a person in custody”.

This guidance is being highlighted as a consequence of a report that the Society required to consider relating to a solicitor who passed on an item provided to him by a member of the client’s family to Reliance officers. Examination of the item revealed contraband material and practitioners will readily appreciate that difficulties were caused for all concerned.

It is understood that Reliance officers are under instructions not to pass on anything received from solicitors so this issue should not arise again, but the report emphasises that the only safe thing to do is to pass on nothing save the aforementioned business card or legal documents.
