Order confirms surveyor's liability

A ministerial order confirms the surveyor's liability to the buyer where a defective home report leads to material loss
The Minister of State at the Scotland Office has signed an order (SI 2008/1889) under s 104 of the Scotland Act 1998, which creates a formal liability towards the buyer for a surveyor who has provided a survey in a home report, in the event of material loss due to the home report not meeting the requirements of the order. This puts the buyer in a similar position to the seller who instructed the survey.
