In October’s Journal I brought people up to speed with what the PSG was doing. As we come out of the winter months, we can assure property lawyers that we have not been hibernating.
If you go to our website (www.psglegal.co.uk) you will find a licence for works agreement and a guarantee as further additions to the suite of “management documents” the PSG has been preparing. A form of tripartite licence for works agreement (head tenant/tenant/ subtenant) will follow shortly.
The PSG has also been working on a Scottish version of the City of London Law Society Certificate of Title (fifth edition), which as noted in our previous article is the industry standard in England, with its multifarious kilted versions rapidly becoming so also in Scotland. A draft sixth edition of the CLLS certificate is now at a fairly advanced stage, and in the summer the PSG will therefore produce a Scottish version of that edition rather than complete its work on the fifth. The PSG will be working alongside the CLLS on this project, and it is hoped that the new forms of certificate of title can be issued around the same time.
Of equal interest to the profession no doubt, the PSG is actively working on producing forms of post-feudal reform documentation; these will be available in early summer. The suite of documents will comprise forms of disposition, deed of servitude, deed of conditions and deed of real burdens. Professor Kenneth Reid of the University of Edinburgh has kindly undertaken to review them on behalf of the PSG.
Other projects, such as a legal opinion letter, remain on the horizon.
The PSG continues to be grateful to the various consultee firms who have commented on, and improved, embryonic drafts of the documents produced to date.
