POCA seizure threshold down

The cash seizure minimum threshold amount under the Proceeds of Crime Act 2002 has been lowered to £5,000


As from 16 March 2004, the Proceeds of Crime Act 2002 (Recovery of Cash in Summary Proceedings: Minimum Amount) Order 2004 is in force. This means that the cash seizure minimum amount threshold under section 289 of the 2002 Act has been lowered from £10,000 to £5,000. The section provides a search power to seize cash that is the proceeds of, or is intended for use in unlawful conduct, exercisable where the suspect cash is thought to be at least £5,000. A code of practice in connection with the exercise of the power by constables in Scotland has been produced and should be available at all police stations and ports where use of the power is likely.
