Death row Scot will learn if he is free today
Kenny Richey, who has been on death row in Ohio for 19 years, will today learn if he is to be released or faces a new trial.
The Scot, convicted of killing a two-year-old in a fire, had his conviction overturned in February but has remained in prison since then while the state has questioned the appeal court's ruling.
Putnam County prosecutor Gary Lammers will announce whether he is going to call for a retrial today. If he decides against it Richey could be free in a week.
Richey's lawyer Ken Parsigian said he was "cautiously optimistic".
