Clerk leaves court after war of words with solicitor


A clerk walked out of a courtroom during a trial at Caithness District Court after a disagreement with an Aberdeen-based solicitor.

The legal ramifications of David Neill's exit from the court on Tuesday are still being considered by the Crown Office. Lorry driver Donald Bain of Thurso is waiting to see whether or not he will face charges of driving with an excess load.

Mr Neill left the court just before Tuesday lunchtime, indicating that officials would have to find another clerk and start the case all over again. Solicitor Taco Nolf had accused him of repeatedly exceeding his powers by ruling on objections.

Mr Neill said he had just been doing his job and accused the solicitor of holding up proceedings.

Justice of the Peace Donald Harper adjourned proceedings following Mr Neill's exit.

A spokesman for the Crown Office and Procurator Fiscal Service said the Crown Office was currently considering whether or not to bring fresh proceedings. Mr Neill is employed by Highland Council and a spokeswoman from the council said it was not their policy to comment on whether or not Mr Neill will now face disciplinary action.
