OAP who could not produce licence allowed fixed penalty level fine
A pensioner who was unable to pay a fixed penalty fine for speeding because his driving licence was being renewed, saw his £175 fine for the offence quashed by the appeal court yesterday.
The Scottish Criminal Cases Review Commission had intervened in the case of 78 year old Nathaniel Millar of Glasgow, who was caught by speed cameras five years ago driving at 65mph on a 50mph stretch of the Forfar bypass.
Mr Millar was offered a £40 fixed penalty but could not take it up because his licence had been sent to Swansea. He was prosecuted and fined £175 in Forfar District Court. An appeal was refused but after Mr Millar sought the help of the Commission, his case was referred back to the appeal court which this time found in his favour.
No written reasons have yet been issued.
