Mistake in summons leads to prosecutions being thrown out
Anti-speed camera campaigners have been celebrating the dismissal of seven English test cases prosecuted under the wrong statutory provision.
Motorists have been advised to examine cases brought against them "with a fine-tooth comb" after a judge at Southampton Crown Court dismissed the prosecutions because they were brought under the section of the Road Traffic Regulation Act 1984 that deals with general rather than temporary speed limits.
The cases were brought against drivers who had challenged £60 fixed penalty notices sent after they were caught by cameras on the A33. Drivers who have accepted their penalties will have no appeal.
