Legal threat to M74 extension

Green complaint to EU over anti-competitive practices in tendering process

A formal complaint has been lodged with the European Commission about the Scottish Government's handling of the M74 extension, according to today's Scotsman.

The complaint has been made by the Green Party, which claims ministers broke the rules over tendering for the contract for the work.

The Greens say two key European Union rules were broken during the process and want the Commission to halt the project, to which the Greens are vehemently opposed.

The objection is to the decision by four potential bidders to combine as one consortium to tender for the work and ministers unifying two contracts into one.

The EU has recently tightened its rules against anti-competitive processes in government procurement.

The government agency Transport Scotland said legal advice had been taken at all stages of the process.
