Complaints deadline to change

7 July 2008

Members of the public who have a complaint against their solicitor should note that the time limit for making a complaint is to change from two years to one.

The reduced time limit is to improve the transition of complaints from the Law Society of Scotland to the new Scottish Legal Complaints Commission which opens on 1 October 2008.

Mary McGowan, deputy director of client relations at the Society, said: “From 1 October clients will have one year to make complaints.

“Regardless of the new time limit, it is best for everyone that complaints are investigated as soon as possible after the event has occurred as memories are fresh and paperwork is intact and available.

“The Commission has indicated it will have a one year time limit for making complaints, so this will bring the Society into line with the Commission.

30 September 2008 is the deadline for those who wish to raise a complaint with the Society about service by a solicitor completed in the past two years. It is also the deadline for those who only became aware in the last two years that they may have a complaint.
